The legal challenge was never going to be truly successful. I haven't read a single LGBT news source that has shown any surprise about it. It was a necessary step though in order to get new ballot in the next election, and even then most say that it was going to a ballot no matter what the court ruling was.
In reality in every state that "gay" marriage has been "allowed", it hasn't gotten there unopposed, nor is it stable enough within the public consciousness, nor in the law that it might not be successfully challenged in the future. Remember that the same day that Prop 8 was passed there were two other anti-gay marriage propositions and an anti-gay adoption proposition voted on and passed by the people of other states.
With the US we are dealing with a radical fundamentalist christian nation. I think we need to concentrate on removing Australia from the US's cultural grasp whilst we still can, and then the rights of LGBT people in Australia might advance. Let us lead the world, lets not follow anymore.
